Bad A123 pack from dewalt!?!?!

So I already have 4 Dewalt a123 packs and if that wasn’t enough I though I would pick up two more to add to the mix. Instead of purchasing them though ebay and buying individually I got a DC900KL drill kit which comes with two batteries off Craigs List. The kit was brand spankin’ new and completely sealed. I opened it up and tried to spin the drill up with the battery that was attached but there was no movement at all, the BMS must have tripped. No big deal I thought but then tried the other battery and it worked great. After a complete charge I test both packs and my fears came true. The one pack that had a charge upon receipt gave a decent first run of 2.02 ah while the other a terrible 1.30 ah.

My question is….NOW WHAT!?!?! I have in no way modified the battery yet and tested direct from the terminals. So do I make up a story like “3 flashing lights on charger then finally worked but only drill 5 holes before it dies” kind of crap, or “it’s really not very strong with that battery” and try and get it replaced? Does anyone have experience with Dewalt’s warranty service? Oh PS no receipt because it was Craig’s list.

Even the Chas method might not work, unless you purchase a replacement and have a receipt.
